Terms of Service

These Terms of Service («Terms») govern your use of the RemoteXY service, including related mobile applications, web applications, websites, cloud services, and libraries (collectively referred to as «Service», «We», «Our»). These Terms constitute an agreement between you and EV CODE LABS LLC, a company registered in the Republic of Armenia.

These Terms include specific conditions for RemoteXY mobile applications. Mobile app users are also required to comply with the App Terms of Service, available at: https://remotexy.com/en/app-terms-of-service/

By using our Service, you agree to these Terms.

1. General Provisions

The RemoteXY Service provides tools for creating graphical interfaces to control microcontroller devices via Bluetooth, Wi-Fi, USB, and the Internet. All components of the Service are available under the terms described below.

2. License Types

The RemoteXY Service offers the following types of licenses:

2.1 Free License

Provided free of charge to all users.

Features:

• All supported connection methods to controllers
• Any number of devices with any number of graphical interfaces

Limitations:

• Basic set of control elements only
• Maximum of 5 elements and 5 variables per graphical interface

Permitted Use:

• Personal, non-commercial use only, including familiarization with the Service, learning, prototyping, and testing

Prohibited Use:

• Any commercial use, including (but not limited to) selling, renting, or charging for devices or services containing RemoteXY projects, as well as use in commercial, industrial, or governmental environments that generate direct or indirect revenue

2.2 PRO License

Provided for a fee.

Features:

• All Free license features
• Full set of control elements without limitations on the number of elements or variables

Permitted Use:

• Personal and commercial use (including selling devices, providing services, and use in business projects)

Commercial Use Requirements:

• Each end-user of the RemoteXY mobile application must purchase the PRO license independently via the in-app purchase system

Purchase Process:

• PRO licenses are purchased exclusively within the RemoteXY mobile application via the in-app purchase system of the app store from which the application was installed. The license is tied to the user account in the corresponding store and is valid on all devices connected to that account

2.3 Developer License

Provided for a fee.

Features:

• Same as the PRO license

Permitted Use:

• Development and distribution of commercial projects without requiring end-users to have a PRO license

Purchase Process:

• The Developer license and the required end-user limit are purchased on remotexy.com or directly from EV CODE LABS LLC. After payment, the license and end-user limit are linked to the account on remotexy.com

License Term:

• With an active Developer license, you may create and distribute projects with RemoteXY graphical interfaces, where end-users are exempt from purchasing a PRO license
• End-users are exempt within the paid limit of such users
• Projects created during the active Developer license period retain the right to be used and distributed by end-users without a PRO license even after expiration or termination of the Developer license, strictly within the paid end-user limit

Definition of End-User and Limit Calculation:

• For Developer license limits, an end-user is defined as a unique installed copy of the RemoteXY mobile application (identified by an internal immutable installation ID) that has connected at least once in the last 15 calendar days to any of your devices
• The total number of active users is the current number of such unique installations recorded by the system at any given moment as “active in the last 15 days”
• If the paid limit is exceeded, new unique installations that were not previously active in the last 15 days cannot connect to your devices until the total number of active users falls below the paid limit or until you increase the limit via additional payment

3. Intellectual Property Rights

EV CODE LABS LLC and its affiliates own all intellectual property rights in the RemoteXY Service, including the online graphical interface editor, microcontroller libraries, mobile applications, cloud servers, websites, text, and graphic materials.

Nothing in these Terms grants you any ownership or exclusive rights to any intellectual property owned by EV CODE LABS LLC or its affiliates. All rights not expressly granted are reserved.

3.1 Online Graphical Interface Editor

You retain full ownership of all rights (including copyright, intellectual, and proprietary rights) in:

• All data, images, configuration files, and code that you upload or input into the online editor («Input Data»)
• All images, configuration files, and source code generated by the editor based on your Input Data («Output Data»)

You are fully responsible for ensuring your Input Data:

• Does not infringe third-party rights (copyright, patents, trademarks, etc.)
• Does not contain illegal, malicious, or prohibited content

We grant you a perpetual, non-exclusive license to use, modify, compile, distribute, and sell Output Data, including automatically generated source code, as part of your projects.

By using the editor, you automatically grant EV CODE LABS LLC a non-exclusive, royalty-free license to use, copy, store, transmit, modify, and display Input and Output Data to provide the Service, prevent abuse, and perform security, compliance, and moderation operations. We will never sell, license, or transfer your Input/Output Data to third parties for commercial purposes and will not claim copyright on it.

3.2 RemoteXY Microcontroller Library

The RemoteXY microcontroller library is provided under the MIT License. Full license information is in the LICENSE file in the root directory of the RemoteXY library (https://github.com/RemoteXY/RemoteXY-Arduino-library).

This allows you to freely use the library in personal and commercial projects, modify it, distribute, and sell devices with firmware containing the library without additional fees.

Any third-party libraries or dependencies used or recommended by RemoteXY are subject to their own licenses. You are responsible for complying with their terms.

3.3 Source Code Generated by Online Editor

Source code generated by the RemoteXY online editor is considered Output Data and governed solely by Section 3.1 of these Terms.

3.4 RemoteXY Mobile Application

We grant you a perpetual, non-exclusive license to install and use the RemoteXY mobile application (available on Google Play, App Store, and other app stores) solely according to your active license type (see Section 2).

3.5 RemoteXY Cloud Server

3.5.1 Public Cloud Server (cloud.remotexy.com and other servers deployed and maintained by us)

We grant you a perpetual, royalty-free, non-exclusive right to use our public cloud servers deployed and maintained by us solely for personal purposes, learning, experimentation, prototyping, and testing.

Commercial use requires a valid PRO or Developer license (see Section 2).

3.5.2 Self-Hosted RemoteXY Cloud Server

We grant you a perpetual, royalty-free, non-exclusive license to install and use the RemoteXY Cloud Server software on your own or rented servers without limitations on the purpose of use, including commercial use.

4. Restrictions

You may not:

• Decompile, reverse engineer, disassemble, or otherwise attempt to access the source code of any RemoteXY software product (including mobile apps, online editor, cloud server, website), except where expressly permitted by the applicable license (e.g., MIT license or editor-generated code)
• Modify, create derivative works, or distribute modified versions of the RemoteXY mobile application, online editor, cloud server, or any other closed Service components
• Remove, hide, or alter any copyright, trademark, license, or legal notices in applications, libraries, generated code, or RemoteXY websites
• Bypass, disable, or interfere with license verification systems, functionality restrictions, or any technical protection measures in the Service
• Use the Service (including online editor, libraries, cloud server, and mobile applications) to:

• Develop or distribute malicious software
• Violate applicable law
• Perform actions that may result in civil or criminal liability

5. Disclaimer of Warranties

The Service, including all components (mobile apps, online editor, libraries, cloud servers, websites, and generated code), is provided «as is» and «as available».

EV CODE LABS LLC makes no express or implied warranties, including but not limited to:

• uninterrupted, timely, secure, or error-free operation of the Service
• accuracy, reliability, or correctness of the Service or its results
• fitness of the Service for any particular purpose
• compatibility with your hardware, software, or network infrastructure

Use of the Service is at your own risk.

6. Limitation of Liability

To the maximum extent permitted by applicable law, EV CODE LABS LLC, its affiliates, officers, employees, and partners are not liable for:

• any indirect, incidental, special, punitive, or consequential damages
• loss of profits, revenue, data, business reputation, or business interruption
• damages arising from use or inability to use the Service

EV CODE LABS LLC’s total liability for any claims related to the Service, regardless of the basis (contract, tort, negligence, or otherwise), shall not exceed:

• the amount you actually paid for the license in the last 12 months,

or

• 100 (one hundred) USD,

whichever is greater.

These limitations apply even if EV CODE LABS LLC was advised of the possibility of such damages.

7. Suspension and Termination of Access

EV CODE LABS LLC reserves the right, with or without notice, to suspend or terminate your access to the Service, in whole or in part, in the event of:

• violation of these Terms
• bypassing or attempting to bypass license restrictions
• abuse of Service functionality or cloud resources
• creating a threat to the security, stability, or normal operation of the Service

Upon termination:

• granted licenses terminate, except for rights to Output Data explicitly preserved by these Terms
• you must cease use of closed Service components

Suspension or termination does not limit EV CODE LABS LLC’s rights to protect its legal interests by other means.

8. Use of the Service with Physical Devices

The Service is intended for developing and controlling user-owned microcontroller devices. EV CODE LABS LLC does not design, manufacture, test, or certify user devices.

You acknowledge and agree that:

• you are fully responsible for design, testing, operation, and safety of your devices
• you must ensure your devices comply with all applicable technical, industrial, and legal requirements, including safety and certification
• EV CODE LABS LLC is not responsible for any damage, injury, or loss caused to equipment, property, health, or life resulting from use of the Service or controlled devices

The Service is not intended for systems where failure could lead to death, bodily injury, or significant material damage (including but not limited to medical, emergency, nuclear, or transportation systems).

9. Force Majeure

EV CODE LABS LLC is not liable for any total or partial failure to perform obligations under these Terms if caused by circumstances beyond its reasonable control («force majeure»).

Such circumstances include, but are not limited to:

• failures or outages of communication networks, data centers, hosting providers, cloud platforms, or third-party services
• power interruptions or outages
• cyberattacks, malicious actions of third parties, DDoS attacks
• natural disasters, fires, floods, earthquakes, or other catastrophic events
• wars, armed conflicts, terrorist acts, mass riots
• actions or decisions of government authorities, including sanctions, restrictions, blockages, or changes in law
• epidemics, pandemics, or related restrictions
• other circumstances beyond reasonable control

In such cases, EV CODE LABS LLC may temporarily suspend or fully discontinue the Service or its functions for the duration of the event without any liability.

EV CODE LABS LLC does not guarantee data preservation, availability, or recovery during force majeure events.

Resumption of the Service after force majeure is at EV CODE LABS LLC’s discretion and subject to technical and legal feasibility.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Armenia.

All disputes arising from or in connection with these Terms shall be exclusively resolved in the courts of the Republic of Armenia, unless mandatory law provides otherwise.

11. Updates and Changes

EV CODE LABS LLC reserves the right to unilaterally update these Terms. Changes are published at remotexy.com and take effect upon publication. Continued use of the Service after changes constitutes your acceptance.
